Facebook India moves SC seeking to set aside Delhi Assembly Panel Notice

Bengaluru: Facebook India Head Ajit Mohan has moved the Supreme Court against a notice from the Delhi Assembly's "Peace and Harmony" committee probing the hate speech matter linked to the social media platform and Delhi riots.
A three-member bench of the top court - consisting of Justices Sanjay Kishan Kaul, Aniruddha Bose, and Krishna Murari - will hear the plea on Wednesday, the Apex Court’s website showed.

Last week, AAP MLA and committee head Raghav Chadha said Facebook's refusal to appear before the committee is an attempt to conceal crucial facts and evidence in relation to its role in the February 2020 Delhi communal riots violence.

He had warned that if Facebook refused to appear before the committee again, it will not hesitate to use all its powers including coercive measures. He added the refusal will lead to “breach of privilege" proceedings against Facebook’s officials.

Facebook has previously conveyed to the committee through a letter dated September 13 that it has appeared before the parliamentary panel and that regulation of intermediaries like Facebook fall within the exclusive authority of the Union of India.

It also stated the subject of law and order in the NCT of Delhi also falls within the exclusive domain of the union of India.
