Minority institution moves SC over ruling on teachers' appointment

New Delhi: Days after the Supreme Court upheld the right of the Bengal government to set up a statutory board to oversee appointment of teachers in madrasas, a minority institution has moved the top court seeking to have it set aside as violative of the court’s larger bench ruling in the TMA Pai case.

The TMA Pai case allowed absolute autonomy to these institutions to run their own affairs. The court ruling in a recent case allowed the state to take away this power of appointing teachers from madrassas to assign it to a statutory board.

The state claimed that this was necessary to streamline the process and ensure quality in the recruitment. A bench comprising Justice Arun Mishra and U.U. Lalit had upheld the constitutional validity of the state’s 2008 law.
