ET BureauBENGALURU: Former Uber senior vice-president Emil Michael has filed a motion asking a judge to dismiss a lawsuit, according to a report by Recode.
The lawsuit concerns the medical files of a woman who was raped in India by her Uber driver in December, 2014.
Earlier this year, Michael had quit Uber over reports of mishandling of the woman's medical records. The documents indicate that the case will be heard on December 1, 2017 in the United States District Court in the Northern District of California.
According to the document, the defendant, Michael seeks an order dismissing the plaintiff's complaint for failure to state a claim because the plaintiff has not met the burden of pleading sufficient facts on the three causes of action alleged against him, specifically for intrusion into private affairs, public disclosure of private facts, and defamation.
When it comes to intrusion into private affairs, Michael claims in the document that the lawsuit does not allege that he had anything to do with obtaining the medical records. It only mentions Uber's former APAC head Eric Alexander. In June 2017, Alexander quit after it came to light that he had obtained and held the medical records of the Delhi rape victim for about a year.ar.
