    Tobacco industry voices concern over govt's draft cigarette and other tobacco products bill

    The tobacco industry feels the government’s latest draft cigarette and other tobacco products bill, which it expects will curb smoking, is “draconian” in parts and is a regulatory overreach when India already has amongst the most stringent regulations globally.
    The Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) (Amendment) Bill, 2020, has proposed increasing the smoking age from 18 to 21 years, ban sale of loose cigarettes, do away with smoking rooms in airports and restaurants, and increase penalties for flouting public smoking rules.

    The draft bill made by the health ministry has been put in the public domain for stakeholder consultation.

    “The draft bill has several provisions which are draconian and given that the country already has amongst the most stringent regulations globally, this kind of regulatory overreach is not warranted,” TII director Sharad Tandan said in an emailed response to ET.

    He said TII expects once all stakeholder consultations are over, the government will take a balanced view before taking it to the Parliament.

    “It is a well-known fact that excessive regulation pushes the trade underground and results in it being taken-over by anti-social elements and criminals. The current regulatory environment has already made India the hot bed of illicit trade. India today is the fourth largest illicit market for cigarettes in the world and also the fastest growing market,” said Tandan.

    TII said the illicit trade is controlled by criminal syndicates and terror groups which has already been acknowledged by several organisations including FCTC and US Homeland Security. “The final provisions we believe will be in the interest of India and its citizens,” the organisation said.

    The share price of India’s largest cigarette company, ITC Ltd fell by 2.86% on Wednesday when the benchmark Sensex too plunged by 0.54%. The share of other manufacturers such as Godfrey Phillips India closed at 1.43% lower and VST Industries plunged by 1.37%.

    The cigarette retailers body, Federation of Retailers Association of India joint secretary Gulab Chand Khoda said the livelihood of four crore retailers will be affected at a time when the trade is badly affected due to Covid and lockdowns.

    “The draft rules are very stringent including jail term and hefty fines which are not there in any country. We expect the government will be sympathetic towards the industry in tough times like these,” he said.
